Agency terms and conditions

The Hiring Contract is between the client and the owner of the property for which the booking is made, and is subject to the following conditions. Endeavour Cottage

Agency act as agents for the owners and are not principals.

1. Whilst Endeavour Cottage Agency (hereinafter called "The Agency") uses its best endeavours to ensure the accuracy of all information supplied and details

of properties are given in good faith, no warranty is given as to their accuracy and it does not accept responsibility or liability for any loss or damage resulting

from information given or statements made whether verbally or in writing.
2. The Agency acts only as agent for the owner of the property and can give no guarantee or warranty as to the state or condition of the property. The

Agency will not be liable for any act, neglect or default on the part of the owner or any other person nor for any accident, damage, loss, injury, expense or inconvenience whether to person or property which the Client or any other person may suffer or incur.


3. A deposit of 20 percent of the total owed is payable to secure the booking. If the booking is made eight weeks or less before the commencement of the holiday, then the full rent should be paid at the time of booking. If a booking cannot be accepted by the Agency, the full amount paid will be returned within 14 days.

If a booking is accepted, the client becomes liable for the balance of rent for the full period of the holiday, which must be paid eight weeks prior to the holiday. If a deposit is paid eight weeks before the holiday or a final payment is made less than eight weeks before the holiday but then the booking can be cancelled by the client, we will refund the money paid only if another booking is made. When the balance of the rent is paid as above, final details of the property, with routing and key holder information are forwarded read above.


If for any reason the property becomes not available for a future booking already made for any reson, the agent is not responsible, the owner of the property is fully

responsible. Under these circumstances the agent will refund the 20% deposit and any final payment should be refunded by the owner who will have received the payment.

CONTRACT OF HIRE for Endeavour Whitby Holiday Cottages which is a company trading name.

The hiring contract is between the Holidaymaker and the owner of the cottage for which the booking is made and shall be deemed to be made Subject to the Conditions of

Hire herein.

Endeavour Whitby Holiday Cottages act as agents for the owners for the holiday propeties and are not Principals. The Contract of Hire is not effective until Whitby

Holiday Cottages give written confirmation of a booking to the Holidaymaker.

INITIAL PAYMENT
Bookings will be confirmed upon receipt of the deposit payment. If the booking is made within 56 days of the commencement of the holiday date, then the full payment and any extra costs as appropriate.

BALANCE PAYMENT
The balance of the holiday booking payment will be due 56 days prior to the commencement of the holiday date. Whitby Holiday Cottages reserve the right to cancel a holiday where full payment has not been received at least 28 days before the commencement date.

CONFIRMATION OF BOOKING
The Holidaymaker is responsible for the total published price of the property and any extras as shown on the Confirmation once the Confirmation of Booking has been issued by Whitby Holiday Cottages.

BOOKING CANCELLATION
Additional Holiday Cancellation and Curtailment Protection Insurance is NOT provided by Endeavour Whitby Holiday Cottages and if required should be taken out independently by the holiday makers. As an alternative, the Holidaymaker may make direct arrangements for Holiday Cancellation and Curtailment Protection Insurance with other insurance companies.

If insurance is taken out directly by the holidaymaker and the holiday is then cancelled but the reason for cancellation is outside the protection provided by any scheme, then the deposit paid on booking will be automatically forfeit if Endeavour Whitby Holiday Cottages does not managed to achieve another booking for the full period of the cancelled. Provided written notice of cancellation is received by Endeavour Whitby Holiday Cottages not less than 8 weeks before the commencement of the holiday date, Holidaymakers covered by the scheme will not be held liable to pay the full balance of the holiday booking. If, however, cancellation is notified within 8 weeks of the commencement of the holiday date (Or if the Holidaymaker is cancelling at any time, but is not covered by the scheme) the Holidaymaker will be liable to pay the full balance of the holiday booking unless Endeavour Whitby Holiday Cottages have been successful in re-letting the holiday. Any refund made will be subject to an administration charge of £40 in favour of Endeavour Whitby Holiday Cottages plus any expenses incurred by the owner in accepting a late booking where, for example, a discount has been deemed necessary in order to secure a replacement booking. In all instances, cancellations must be notified immediately in writing to Endeavour

AMENITIES
Whilst every care is taken to ensure that accommodation and amenities are suitable for use as described it is expected that all holidaymakers exercise caution and provide adequate supervision where necessary to prevent injury or damage. If in doubt or should you have any concerns over safety aspects please contact the owners directly as the holiday letting agency is not responsible.

MOTOR CAR AND PERSONAL BELONGINGS
Personal belongings are at the Holidaymaker's risk at all times. No responsibility can be accepted for loss or damage to any vehicle or its contents.

PARTY SIZE
Under no circumstances may more than the maximum number of persons stated in the Brochure occupy a property. Owners reserve the right to refuse admittance if this condition is not observed. In addition Endeavour Whitby Holiday Cottages and the owners reserve the right to refuse or revoke (before or during the holiday) any bookings from parties which may in their opinion (and at their sole discretion) be unsuitable for the property concerned.

HOLIDAYMAKER'S RESPONSIBILITIES
The Holidaymaker is responsible for the property and is expected to take all reasonable care of the same. All equipment, utensils, etc. and the property must be left clean and tidy at the end of the holiday period.

DAMAGE
Damages and breakages are the legal responsibility of the Holidaymaker and such costs shall be refundable on demand by the owners of the property.

COMPLAINTS PROCEDURE
If the Holidaymaker is not entirely satisfied with the accommodation offered then he should contact the owner or his representative immediately and attempt to resolve the problem.If for any reason you cannot contact the owners of the property you can contact the holiday letting agency so we can pass the information on but the agency itself will not be responsible, full responsibility lies with the owners of the property.

If the Holidaymaker feels that the problem has not been resolved to his satisfaction he should forward full details of the complaint in writing as soon as possible to Endeavour Whitby Holiday Cottages in order that we are able to act quickly in helping to resolve a dispute arising from any such complaint.

Endeavour Whitby Holiday Cottages WEBSITE
Endeavour Whitby Holiday Cottages take every care to ensure the accuracy of all property descriptions. All information is given in good faith and assumed to be correct at the time of printing/ publishing on the Internet, but we cannot be held responsible for any errors, or the results of such errors. Furthermore Whitby Holiday Cottages cannot accept liability for happenings outside our normal reasonable control, such as breakdown of domestic appliances, wiring, plumbing, sudden temporary invasion of pests, any damage resulting from exceptional weather conditions or owner's negligence resulting in loss, injury or accident. Neither can Endeavour Whitby Holiday Cottages accept liability for changes to (or withdrawal of) specified area amenities mentionedon our website.

AVAILABILITY
The Hiring Contract is made on the understanding that the property and its facilities as stated will be available for the dates stated. In the unlikely event of the property being unavailable through events arising out of the control of Endeavour Whitby Holiday Cottages, or the owner, then Endeavour Whitby Holiday Cottages may be forced to cancel the booking. The Holidaymaker will be advised of any such circumstances as early as possible and will (where feasible) be offered alternative accommodation of a similar type, standard, price and location. If this is not possible, or if the alternative property offered is unacceptable to the Holidaymaker, then Endeavour Whitby Holiday Cottages will refund the initial 20% deposit which was taken by the agency. The remaining 80% payment made by the holidaymakers should be refunded by the owners of the property who are responsible having received that money by bank transfer from Endeavour Whitby holiday cottages. Endeavour Whitby holiday cottages is not responsible under any circumstances for refunding the second 80% payment date by the holidaymakers, the owners of the property are totally responsible to refund that payment.

These conditions may be subject to change without prior notice but are correct at time of going to print.
